More Ballots Found in Minnesota Senate Recount

Democrat Al Franken's campaign said another 12 uncounted ballots have been found in Minnesota's contested Senate election, while announcing it would withdraw an additional 425 challenges to ballots issued during the race's hand recount.

Franken's campaign said that a dozen "UOCAVA" ballots had been found in a Minneapolis-area warehouse by election officials searching for 133 ballots gone missing during the hand recount in the urban center's 3rd ward, 1st precinct. The ballots come from uniformed and overseas voters and were previously unopened and counted, Franken officials said.

"We believe strongly that these ballots should and must be counted prior to the conclusion of the recount," said Franken attorney Marc Elias in a Monday afternoon conference call. "There is considerable precedent for opening and counting this ballots."

The Coleman campaign expressed skepticism toward the newly-found ballots. "As the Minneapolis elections director stated, these ballots were unsecured and chain of custody procedures were not followed," said Coleman campaign spokesman Mark Drake. "They are subject to great question."

Elias reiterated the campaign's demand that election officials continue their search for the missing 133 ballots, but expressed optimism that if the ballots are not found, the state's Board of Canvassers would likely revert to the election night tally, following the Minnesota Secretary of State's stated preference to resolve the situation should the ballots not be found.

The campaign meanwhile withdrew 425 challenges it said it expects to face "no reasonable chance" of being upheld in front of the Board, when it convenes to review challenges December 15.

"We’re continuing to review all challenged ballots and look forward to sitting down with the Franken campaign to whittle down the number of challenges," Drake said.

Claiming a four-vote advantage over Sen. Norm Coleman (R) in their internal tally, Franken's campaign also reiterated its demand that Minnesota counties sort out absentee ballots per a Secretary of State directive that may yield votes, if the Franken campaign is able to have votes they allege were improperly disqualified counted.

Some counties have not yet complied with orders to sort the ballot into five categories, the fifth of which the Franken campaign claims includes absentee ballots for which there is no legitimate reason for disqualification.

"I don't know of any good reason why a county would refuse to sort," said Elias, who refused to name which counties have not yet complied. "I'm trying to give these counties an opportunitity to work with the Secretary of State's office to address their concerns."

The campaign said it has not seriously thought about options to order those ballots be counted, including lawsuits or appealing to the U.S. Senate.

"There are a number of people who ask me from time to time about the status of where the recount is," Elias said. "It's typically about the count. We've said consistently we're taking this one step at a time. The questions I get relate to what's the count and where's the process."

    Seriously, when will this end. I am concerned when they "find" ballots. There is no chain of custody on these. How can you validate them as real or just some stooge filling in bubbles in the back of Al campaign HQ?

  13. I have no horse in this race. But any ballot, regardless of who the vote is for, should be disqualified if the control of these documents have been comprimised. I think "lost" and suddenly "found" ballots would constitute a document that has not been under election officials control.

  14. This has been, and continues to be a huge embarassment to the many good citizens of MN (What happened to the 1mm + that somehow voted for Stewart "I'm worth it"??). Now there's talk that Sen. Reid and Sen. Schumer are considering bringing the entire election decision before the U.S. Senate, which would suggest a vote to seat Al despite the counted votes; maybe it's the cold weather, but something is horribly wrong in the land of lakes.

  15. I told a liberial Dem. on one of these comment sections several weeks ago, that Franken will win this election…no doubt. This is exactly like the Governors race in Washington State 4 years ago. The Dems kept "finding" votes and after three recounts the Dem finally won. She (Governor) found votes that were always…always in her favor, even in very strong Republican areas. The liberial said I was some crazy conservative, that they can't "find" ballots. So much for that idea. Its sad how that works, the liberials in this country care about only one thing winning and the end always justifies the means…anything to further their agenda…anything. Congratulations Al!!

The reason these ballots keep "popping up" (found them in a warehouse, are you joking?) is that it takes time to properly make a good, fake, forged ballot, one that will pass some scrutiny…Al F. has been reading his Communist Manifesto and Das Kapital, and probably consulting Hugo Chavez and old Fidel again, and will do ANYTHING to become a member of the Politburo…I mean, Senate, gosh, what was I thinking, ha ha…

  61. Coleman should just be allowed to win. The mandatory recount law is unfair because an accurate counting of the ballots might show Franken won.     R's - staunchly defend servicemen so long as they don't wish to vote against R's, so long as they don't try to leave the service to get an education, and so long as they don't end up injured.

  68. This is how a "democratic" recount works. we keep recounting until the Democrat wins. Than that count is certified. All other counts where the Democrat lost do not count.

    Playing sports with a democrat is very similar. You keep playing until the Democrat final is ahead, than that is the final score. No matter how much longer the actual game takes…it doesn't matter. What matters is that when the democrat is finally ahead is when the game ends.

  75. Here is a (partial, I fear) list of states where voter fraud is rather common: Wisconsin, Minnesota, New Mexico, Illinois (Chicago), Pennsylvania (Philadelphia), Washington State, Louisiana, Ohio.

    I worry less about who wins any particular election than I do about the damage to our democracy when the average voter realizes the extent to which they are being had.

  132. We hillbillies have got this all figured out in Kentucky. Have you ever noticed how we're almost always one of the first states to report results in a national election?

    We have these things called "computers" that store the results of each person's vote. There are no hanging chads and no implied intent to be considered because there is no paper ballot. There is instead a diagram of a ballot with flashing button-lights next to each candidate's name and a big button that says "Vote".

    You less backward states should look into these. Once again, they're called "computers". You less technical folk can just call them "machines" if it helps.

  183. If the election night total had Franken ahead by two hundred votes he wouldn't be going through landfills looking for lost votes in trash bags. "Count all the votes" is garbage. They already were counted, on election day. There hasn't been an election in the history of the world where votes were tabulated 100% correctly, the same way there has never been a sporting event where officiating was 100% correct. It's the nature of the process. Some people voted twice. Some ineligible people voted. Until we have secure voter identification cards and do away with paper ballots election results will always be inaccurate.

    "Voter suppression" in Democrat-speak is a synonym for not allowing illegal or improper ballots to be counted. It's only "voter suppression" if the Democrat is losing. It's "preventing Republicans from stealing another election" if the Republican is losing.

  247. In Washington state in 2004 the republican Dino Rossi won the count on election day. It was close so a recount was ordered. Similar to what is happening here.

    He won the recount even after the dems "found" hundreds of ballots. So a second recount was ordered and even more ballots were "found".

    The democrat finally won on the third count and declared the counting was over. Like SeaBob says Paul Berendt was in on that count and he is now advising Franken.

    Be afraid people, be very afraid for democracy.

    As far as Florida 2000, Bush won on election day and he even won the New York Times recount. So that issue should be dead. No stolen election then. The only stolen elections are be democrats.

Generally they keep them open until the democrat vote counters and election judges inform them that the democrat has won. Very efficient because who can stop a judge? It also neatly avoids the need for lawyers.

  331. I'm in Georgia and at first was frustrated by the re-vote required because no candidate got more than 50% in the original election. Seemed like a waste of money. But compared to Minnesota's current morass, I'll take the re-vote every day of the week. If too many votes are suspect and the count is too close to call with any certainty, then let them rerun.   345. The only defense of what Al Franken is doing that I've read in these comments is the lame "COUNT EVERY VOTE!" Surely what you mean to say is "Count every certifiably valid vote!" Yes? As you have seen in these comments, many people from other state are now demanding to vote in this election. You don't really want to count *their* votes do you? Of course not. Most of the people in these comments against what Franken is doing seem to feel that votes 'found in a closet' are clearly *not* a valid vote. How did they get in that closet? Who had access to them before they were found? Why were they put in a closet?

    The people of Minnesota have spoken and, lets face it, they have express no overwhelming preference for either candidate. The actual vote is *clearly* within the margin of error of any vote of this kind and a coin toss is as good as anything to decide the vote. The best thing to do is accept the very first count of the votes, using the process in place. However, since a recount is allowed by law (but Franken could have, and should have, refused it) lets go with the recount. But, please, no heroic measure should be made to 'find' votes. Any 'new' votes should be regarded as highly suspicious and only included if extreme measures are used to confirm it is a valid vote.

The FBI should be investigating this and the democrats that have taken past in this fraud should go to jail.   380. Why don't the Republicans "find" a whole cargo ship full of a BILLION ballots, all for their guy, and pull the mask off this running joke? Every single "mistake" has been in favor of Franken. That tells me that one of two things is true: 1. Franken is cheating. 2. Democrats are too stupid to be allowed to vote. So which is it?

    They'll keep "finding" ballots until Franken wins. My suggestion would be to stop voting in that state. Seriously. Don't waste your time. The best protest for Republicans would be to stay home next time and let the Democrat "win" unanimously.

    The Washington governors race in 2004 went down like this: With most results tallied on election night, Rossi (R) held a narrow lead over Gregoire (D). With mail in ballots counted in the next week, Rossi (R) maintained his slim lead (like 300 votes) over Gregoire. With ballots officially counted, Rossi was certified the winner of the WA Gov's race. However, because the margin was so thin, state law requires an automatic machine recount.
    After the automatic recount, Rossi again held a lead, although it had narrowed (to something like 150 votes). State law allows a third "hand recount", but requires the candidate who requests it to post bond and promise to cover the cost ($1 mil) if the recount doesn't change the result. So the Dems posted $100k and ordered the "hand recount", which was like the Florida recount where partician committees determined "voter intent".
    Gregoire narrowed the deficit in the hand recount, but it became apparent that the results were unlikely to change. And that's when bags of ballots started to be found in unsecured locations. And Dem lawyers going to court saying that "every vote should count". And liberal King County judges agreed, and said that the mysteriosly appearing votes should be counted. And after a bag of votes here and a bag of votes were found there, Gregoire (D) suddenly found herself the winner.
    This is what was going to happen in Florida before the Supreme Court put a stop to it. And it's what's happening in Minn. right now. Dem politics as usual.

  390. So, from what I can tell from this past election is that Americans have all but given up on being Americans. They have totally and completely lost sight of what it means to be an American. You know the whole "for the people, by the people" thing. All of these politicians, on both sides, are looking out for nobody but themselves. Why else would a guy fight so hard for a job that doesn't pay that well, at least legally, and in which you get ZERO respect from the majority of fellow Americans. It is because these people are sick with power. After this election I am looking to move out of this country and try to find a place where my freedom is not eroded on a daily basis, I am not taxed unfairly and I don't have to live in fear that my government has sold out it's people (Clinton/China, Bush/Cheney/Haliburton, Obama/TBA) all for the benefit of a few, themselves.

He lost his base and a recognizeable third party candidate drove another nail into the coffin.   422. I was on a airplane last night from Chicago to MSP. Just arrived. I sat next to a nice gentleman from Chicago. He was taking some ballots he found in his precinct in Chicago to Minnesota for the recount. Magically, they were all for Franken too.

    you people can't even run an election without all of this recount BS. It's really not hard, People vote, people count under security, votes are tallied and the winner is announced. Where in the hell do all these hidden votes come from, how can you "find" votes after an election? How do votes get lost? Someone if fiddling with the elction process, I wonder who that could be?
    By the way Al, I was just shovelling out the cow manure and I found another 15 votes, they're coveres in cow shit but that shouldn't matter to you. By the way I had a voting booth in my cow barn that's how they got there. What Bull shit.

  438. This gives me flashbacks to the three years I lived in Chicago. Do any of our votes really count if it's a close election and the person who is supposed to win isn't? I will continue to vote even though I'm very disenfranchised. What ever happened to the promise that all the voting irregularities, the Attorney General (John Mitchell), was supposed to investigate after the 2000 election?

  440. Mark my words, you saw the exact same thing in Washington. As soon as Al Franken has enough votes to win, the Sec of State will call the election. Any ballots that suddenly appear out of thin air should be discounted. This is a sad, sad commentary on our voting procedures when a losing candidate can not only drag out an election until he wins, but can also force the state to spend all that money on a recount. When will it end.

  441. The one constant of Republican theory is that votes don't matter. Where as Democrats believe that every vote should be counted, Republicans supress, vote shift and bully their way to election victory. Afterall its how they won the Whitehouse twice.     Despite all of the Democrats cleaning up in the Presidential, House, and Senate elections, poor, poor Al has to scrape and beg and cheat in a failed attempt to become a Senator.

    His camp keeps using that BS line that they are ahead in votes . . . of course they base that on how many "challenged" votes each candidate submitted. Yea, right. like all those challenged ballots will be accepted.

    Later this year, Al will be moaning on David (the Nazi Liberal)Letterman that he really won the election.

  448. I knew if I read this blog long enough I would find some jerk claiming Bush stole the 2000 election and I was not disappointed….CHRIS.

    Gore attempted to steal the election by demanding recounts only in 3 heavily liberal counties in Florida. Gore is the one that took it to the courts, not Bush. The SCOTUS did not 'declare' Bush the winner. They ruled that a recount had to include the whole state since it was a federal election. At that point Gore withdrew since he knew the result….BUSH WON FLORIDA IN 2000! NOW YOU GET OVER IT JERKS!

  449. The fact that Obama and Franken were even considered for public office is proof that the US is no longer the land of the free. We are being taken down the path to Socialism by Pelosi, Obama, Reid and their ilk.

    The odd part is that out of HUNDREDS of ballots Franken's people have manufactu….err "found, that NONE were for the Republican candidate. Against all statistical odds, not ONE OUT OF HUNDREDS!!!! Which of course is impossible, but do you hear the Republican party screaming about being cheated and voter fraud?

    The Democrats are still screaming voter fraud about the 2004 election!

    Hey, I just had a little bit of flatulence… and I consquently found 17 ballots for Franken!!!!
