Wasserman Schultz: Judiciary Committee Willing To Arrest Rove If He Doesn't Testify

Rep. Debbie Wasserman Schultz (D-Fla.) said that the House Judiciary Committee would be willing to arrest Karl Rove if the former White House official doesn't testify about his role in the firing of nine U.S. attorneys in 2006.

Wasserman Schultz, in an interview on MSNBC Tuesday, echoed the demand of House Judiciary Committee Chairman John Conyers (D-Mich.) that Rove would not be allowed to invoke executive privilege to avoid testifying. Rove could not invoke the privilege since he said he did not have conversations with the president about the attorneys' firing, Wasserman Schultz said.

Asked by MSNBC host Dan Abrams if the committee would go far as having Rove arrested, Wasserman said it would.

"Well, if that's what it takes," she said. "I mean we really cannot allow the co-equal branch of government, the legislative branch, to be trampled upon by the executive branch. The founding fathers established three branches of government. We are a co-equal branch, and this is an administration that essentially has ignored and disrespected the role of the legislative branch for far too long."

Rove said Sunday that the Judiciary Committee has refused to take up offers by his lawyer and the Bush administration that would allow the committee to find the information it's seeking without Rove's testimony.

  3. Nothing but politics. The U.S. Attorney's serve at the will of the President. All members of congress should be arrested for waste and fraud for wasting taxpayers money. If I was Rove would tell congress where they could stick their request and then turn around and sue.   5. Gas is $4 going to $5 and these idiots want to investigate a NOTHING story. Bill Clinton fired over 90 US Attorneys. If you want to waste time call in Hillary Clinton and ask her why her husband fired over 90 US Attorneys, now that would give the Drive Bye Media a tissy fit.

    How about investigating Congress as to why they haven't allowed Oil and Gas Companies to DRILL for our own Oil and Gas. Their 30 years of preventing this DRILLING is a crime worth investigating and most Americans would praise that investigation.

  7. Can the Democrats be any more pompous and political. I wish we could throw all of them out. Last week hearings with the oil company executives was a joke. Rather than working together for a solution, they attack them. The oil company executives should be attacking them for not letting them drill for energy off the coasts and in Alaska.

  9. Wasserman says that Congress and the President are co-equal branches of government, yet the "co-equal" Congress is attempting to force the Executive Branch to submit to the will of Congress.
    If Rove stands on Executive Privilege, then the matter will be taken up by the Supreme Court, and maybe by next year or so we'll have a decision.

  11. I don't recall in the constitution where it says a congressional commitee has the power to "arrest" people; do they have a special police force for these things. Leave it to Abrams at MSNBC to ask a question like that.

    I guess this is our modern day Democrat Party and the left in this country, better be carefull what you say and think, maybe they will arrest you too. Scary.

  15. The role of the legislative branch is to legislate. They are to write legislation and vote upon it according to the stances their constituents voted them into office. Their role is clearly enumerated in the United States Constitution. They have no powers other than those enumerated. The executive is in charge of enforcing the law and commanding the troops so as to ensure the safety and well-being of our nation. While President Bush may have not done this as optimally as could have been done, he has excelled far beyond the level of competency that either Al Gore or John Kerry (or any other member of the Democrat Party) would have shown under the same circumstances.

  19. The US Attorney's aren't part of the Judicial Branch, they are part of the Executive Branch of government, Rep. Wasserman needs a civics lession. Judges and their offices are the Judicial branch.

    So let's waste time on another useless witch hunt. Why not ask why oil has doubled since the Democrats took over Congress.

We can all thank this current US Administration for a crushed middle class, high food prices, high liquid fuels prices, severely degraded International standing, and an illegal war (waged against the advice of military, economic, and political experts). Rove was (and probably still is) an instrumental part of these failures and should be held accoutable. Oh, I did not mention a severe loss of civil liberties, a broken US dollar, and a propagandized press corp. Hooray for the 8 year terms for US Presidents!!! BTW: Pelosi is very weak not to bring impeachment actions against this president and a few others in his cabinet. Very weak indeed.

We are in a shooting war, in the middle of the largest increases for fuel and energy in the history of this country, and are experiencing many other serious problems. And yet this congress wants to waste potentially millions of dollars and hundreds of hours on what amounts to a political stunt to investigate a legal event with historical precdents going back to the beginning of this nation.

  41. The Attorney General's serve at the president's pleasure, it's true, but the President cannot use them as a weapon to punish his political enemies. They are supposed to be prosecuting criminals, not harrassing and threatening the President's political opponents. It appears very strongly in this case the the White House was firing guys who would not go after Democrats–that is, Attorney's General who felt there was not sufficient evidence to prosecute were being fired and replaced with attorney's who were more willing to do the White House's political bidding. If this were the case it's a very very serious matter. It's a breach of the public trust, and very likely a crime. Do you really want an Attorney General who only prosecutes Republicans, or only prosecutes democrats.

    Congress has a right and a duty to oversee the Executive. And in that capacity it should be investigating this matter. Did the White House fire attornies general who would not do its political dirty work? To get answers, it has to talk to Rove.

    Rove is not subject to executive priviledge because he has already claimed that he did not discuss the Attorney General firings with the President. So if he ignores the subpoena he is breaking the law

    If the situation were reversed, and a Democratic President were firing prosecutors who were not going after political opponents,Congress would also be right to investigate

  44. Although the executive branch is subject to investigation and oversight by the legislative branch of government, there is no precondition to the hiring and firing of U.S. attorneys. It is subject to the will and whim of the current administration as as been demonstrated repeatedly before. If there are other issues (e.g. 'illegal war', etc), then those would be in the purview to investigate but this firing of attorney's is a joke.

  60. This is an important development. Many people here are saying this is a 'nothing' story, or complaining about the price of gas. One of Congress' many roles is that of investigator. The price of gas is something that Congress has little direct control over, particularly when we import it from OPEC. That is a matter for the executive. As for unearthing gross abuses of power on the part of the executive, our Representatives have an obligation to fact find and if necessary, push to prosecution. This matter is not so much partisan, as it is about maintaining the balance of power among our government's branches, ensuring transparency, and complying with the doctrines that lead to the foundation of our resilient nation.

Then he and his goose stepping buddies drag the oil companies before the senate (for a dog and pony show) and what does he say…"if the oil companies companies would just negotiate another million barrels a day it would drop the price 65 cents a gallon. Exxon accounts for 2% in the oil market and yet is the highest taxed company in the world. 1% of Exxon is owned by the executives, 40% is owned by individual investors the other 59% is owned by institutions so all you libs better check your 401K and make sure you don't own any.
    The government in the last 3 years has taken in more money than it ever has due to the Bush tax cuts. We can't help they choose to over spend and make sure Nancy Pelosi has fua gra in the lunch room at the capitol.

He fired all of them because one was looking into Dan Rostenkowski and was 30 days from making a ruling that would not be good for Dan. Carter fired one attorney because he was looking into one of Carter's friends. Bush should have fired all 90 and he would have been left alone. If he were a Dem he would be left alone no matter what.

    Timbeaux: Clinton did not fire 90 U.S.A's. At the beginning of each new administration, all U.S.A's routinely submit resignations which are routinely accepted by each new president so they can appoint their own people. Clinton did that at the beginning of his administration just as Bush did in 2000. The 9 U.S. A's who were fired were appointed by Bush. They were fired so they could be replaced by Rove protegees and others to pursue what are considered to be unethical prosecutions before the 2008 election.

  111. It really alarms me to read all of these comments from people who think that congress investigating this issue is a waste of taxpayer dollars. This is the case of 9 U.S. Attorneys who were fired from their jobs, not because Bush felt like replacing them to change up people from an old administration, not because they we doing their jobs poorly, but because they were Democrats. That is not just using your executive power to keep attorneys at the will of the President, that is firing a person on the basis of their political beliefs, which is illegal. It is also illegal to have candidates for a job take a political litmus test. However both of those are things that the Justice Department did, under direction from top aides at the White House. Karl Rove is refusing to testify to the House Judiciary committee, a group of elected officials whose job is to oversee the Judiciary Department. If they see an issue, such as the politisation of of the Justice Department, it's not only their job, it's their DUTY as congressmen to make sure that the practices of the Judicial Department are A: Constitutional and
    B: Meet with the current statutes under U.S. Law

    It's clear that this has not been happening. It is within every right given to the Congress to oversee the Executive Branch, just like it's the Supreme Courts job to make sure that any laws Congress passes and the President signs are constitutionally legal, and if not, the laws or amendments would be struck down as unconstitutional. That is the PURPOSE of Co-Equal branches of government. If the Executive Branch could claim Executive Privilege every single time, and congress never challenged it, then the Executive Branch would be able to literally do whatever they wanted, claim executive privilege, and then not have to pay for any wrongdoing they may have done. It's frightening to me that apathy people have to serving justice and not setting presedence. If we don't prosecute people for committing crimes such as this, it gives others an excuse to do the same in the future, but they'll take it a step further. When a law is broken, those who break them need to be held responsible for their actions. Otherwise there's no point to having laws in the first place. This should not be a partisan issue. The U.S. Constitution is not a partisan document. It is for everyone of every party and protects all of us, Democrat, Republican, Green, Libritarian, etc. We cannot allow ANYONE of ANY party to misuse the power given to them, if we do, we are giving up the freedoms that make us different from so many other countries around the world.

    The problem with our country is evidenced in this and many other posts like it. The discussion isn't about law, powers vested to the branches, the benefit of the course of action, or any other rational educated basis. It is all about personal gratification by name calling, grandstanding, and childish analysis.

    It doesn't matter what you actually stand for or if it is worth standing for in the greater scheme of things; whether it is moral, constitutional, or just. The only thing that matters is that your party "wins" and the other "loses", meanwhile the rest of the rational, sane people with a real stake in the country sees their vote diluted by such base examples of the worst humanity can offer in a human being. As long as the soundbites flow, people “pay”, and the jealous petty brute inside those little minds gets his fill, to hell with reality and elevated concerns.

    It doesn't matter that Democrats, as a party, advance a socialist agenda destined to bankrupt our country knowing that socialism has and will always fail in practice. Who cares that Republicans advance a non-conservative, fiscally unsound, non-fundamental rights based agenda? The silent majority, that tries to live in peace, suffers while moonbats from each side stoke the flames with useless demagoguery and childish antics. The silent majority that will bear the brunt of the cost of socialism to provide benefits to those who do not succeed on their own or they pay for enormous subsidies going to large corporations that milk the government dole to improve their profit margins without providing a benefit to consumers. Most of the moonbats couldn't tell you the powers vested in each branch, what enumerated powers are, what a check-and-balance is, or probably explain simple economic principles. They only care about "winning" and feeling good about themselves to cover up the pitiful existence they live outside the Internet or their little sphere of like-minded, small minded, companions.

    Rational people don’t debate with moonbats because debate requires logical thinking, facts, and integrity; sadly those are qualities lacking on both sides of the aisle these days. There is no winner or loser in politics, everyone stands to lose something when governments act beyond securing rights and property. It is the very nature of government, of course, but how do you explain such fundamentals to someone who thinks like a spoiled brat?

    How much money would we save if we just suspended Congress without pay for the rest of the year, while allowing them to reconvene to prevent the president from doing anything opportunistic? With 500+ members and thousands of offices and staffers, I am guessing it runs past half a billion dollars.

Who are they going to send to arrest him? The house and senate security detail? Just like President Jackson said once to Justice Marshall, "he made his decision, let him try and enforce it."   155. Executive privilege belongs to the President. Rove stated that he did not discuss the issue with the President. Therefore executive Privilege does not apply. Simple. Somebody in these comments actually said that it is unconstitutional for Congress to invesigate the Executive branch. That ability is fundamental to our government and our entire Constitutional system of checks and balances. This is not a monarchy. The founders suffered under a monarchy and did not want another one. They recognized the need for an executive, but went to great lengths to frame the Constitution in such a way that the legislature would be the preeminent power and have the ability to keep the executive branch from running amok. Everything I have just stated I learned prior the the 5th Grade and from watching "Schoolhouse Rock" on ABC during Saturday morning cartoons. I did not need to go to law school (which I later did) to learn these things. You neocons have been bamboozled by this administration, a point made abundantly obvious yesterday by one of the guys whose job it was to bamboozle you, Scott McClellan. Wake up and amdit it. You have been fooled by these criminals. Wake up, get angry, and join the fight to take our country back, to return the rule of law to our land, and most importantly, to bring our troops back home safely from Iraq.

Usually, if the issue is something that reflects extremely negatively on this administration and its special species of Republicanism, like Rove getting handing a subpoena (which threatens to do huge damage to both him and the administration), or Bush and McCain get caught out as (at the end of the day) not really caring so much for the troops, as now when they're opposing a GI BILL that would help servicemen get a college education paid for, some official sounding joker shows up with an alias like: NAVY SEAL or SEMPER FI and begins to go through talking points straight out of the Bush administration or the RNC. They pretend authority and spout off any number of books written by Neocon's (John Bolton for example) and issued by right wing publishing houses attempting to basically squelch discussion and debate with a faux intellectual approach. First thing they will do is blame Liberals for everything from the failures in Iraq (That's Bush's alone guys, really) to the problems in the economy due to "socialist ideology", when clearly this nation has never been more capitalist and owned by the corporations then at any time since the gilded age (another era of massive corruption and profound govt incompetence).

    Anyhow, just something I've noticed. IF you see it happening, pass on this information to others.   164. Parting words… A friend of my brother was at our house visiting. He is a younger man (18 years old, I believe), in the Army, and very gung-ho about it. I admire that. Then he goes on to tell us stories of his stay in Iraq. Turns out, one night, he was supposed to test some equipment, and instead fires a mortar off, hitting a local village. No big deal, accidents happen.

    Then he goes on. There is a story of bravery, where his squad is being fired on and he mans the mounted gun on their humvee and fires back… they survive. I think, wow, this guy has seen a lot, for such a young age. Then his youth shows through; he tells another story about how him and his squad buddies are riding around, and he was bored so he shoots at a sheep in a flock and kills it. A local Iraqi runs out, crying over his dead sheep, and this young man laughs, finding such a notion amusing. "That sheep shouldn't have been in my way" he says.

    Before you leap to conclusions, think about this for a second. That man was probably a peasant, in a modest shack trying to raise a family, with very little to his name. Who knows what that one sheep was worth to him, or how much it would cost to get another. He might not be able to feed his family for a week. He might have to save for months to replace that sheep. To him, that sheep was VERY important; if not part of the family, at least part of it's sustenance. That sheep killing represented a terrible loss to him. So, from the eyes of this innocent citizen, with values and hopes and desires much like our own, he has to deal with armed forces occupying his land, from a strange country, with strange speech and a strange appearance, and these foreigners come to HIS farm and kill one of HIS sheep for their amusement!

    After you've absorbed that a second, think about this - we have hundreds of thousands of troops over there. Do you think this is an isolated incident? Do you think all our soldiers over there are always acting like upstanding human beings? Do you assume for one moment that things like this rarely happen? I would wager all I own that this behavior happens at least 25% of the time, encouraged 10% of the time, and goes unchallenged 95% of the time… and I would wager those are conservative estimates. Face it, we have high school dropouts, drug offenders, gang members, and all manner of bad (as well as good) people serving our country over there. And abuses like this happen A LOT. No wonder they hate us.

    Let me close with this - if foreigners were on your land, armed and acting threatening, shooting your livestock or your pets or any citizen who might remotely look dangerous… in other words, if we were currently being occupied by an armed force, for several years, who you didn't understand at all, what would you do? Would you weep, like this Iraqi did? Would you stand up for yourself, and fight back (and get killed, like we do to 'violent' Iraqis)? Would you leave? How exactly would you feel about that situation?

    Now, keep trying to justify the manner in which we are occupying Iraq.

It does not matter how he came up with the list because it is none of Congress' business anymore than it is the president's business who they hire and fire. Hearings are only allowed to get expert testimony as it relates to legislation and oversight over areas of government under Congessional control. The firing of US Attorney's by the President is not under thier authority, hence, their supeona of Rove is without probable cause. Likewise, hauling major league ball players before congress is not under thier authority either, but they do it because they can get away with it. This is the very reason the founders believed in as little power possible being given to the government. The buffoons think they are the politbureau, which brings up the last point. Why do liberals whine about how screwed up the government is, then turn around and want the government to run everything? In the 1950's 1 in 50 people worked for the governement, now it is 1 in 7.     Wake up, you want renewable energy great, I am all for it. Then where is it? You have had thirty years to come up with it. First it was global cooling now it global warming. No renewable energy yet? Still working on it? How come we cannot drill for our own oil in the meantime?

    the reason Big Oil wants to drill in ANWAR is that the fields at the end of the Alaska pipeline are starting to dry up and they want to extend the pipeline and keep it working which helps spread out the cost of that pipeline.

    most of the oil that comes out of alaska gets bought up by the japanese,very little of that oil ends up on the west coast.

    the only way to get the price of oil to drop is to end the futures market on oil,return oil to the old well head price point like it was before the govt.allowed oil to be traded on the futures market.

    its funny that Cheney holds secret meetings with oil executives back in '01/'02 to set up the nations energy policy and 6 years later we have $4 a gallon gas,I think Cheney gave them just what he promised his Oil Patch buddies.

  251. That US attorneys serve at the will of the President has long been established by both the Constitution and legal (judicial) review. The US attorneys are part of the executive branch, so there is no separation of powers argument here. This stance is hard fact, not opinion. That there are people who either choose to ignore this fact (on the left or right) or willingly distort it is more a reflection of the person holding such a contrary view. To such people, civil liberties are merely a means to manipulate and subjugate individuals to their world view, not, as intended, a codification of immutable rights conferred upon individuals by an authority higher than the government in order to prevent government oppression of its people.

    Such people deserve not our scorn for their manipulations, but our pity for their intellectual vacuity.

  256. The troops that died in Iraq and in Afghanistan know the risks going in and are all volunteers, (except perhaps for a few liberals that joined up for the free college money and did not expect to have to defend their nation in conflict)

    Saddam Hussein did a great job convincing the world (including President Bush) that he had WMD. This fear of course prevented Iran from invading Iraq in 1988 and prevented Iran from trying to put forth an Islamic govt. in place of the Bathe party in 1989. I am amazed how Americans who support the President and his quest for freedom and democracy in the Middle East are listed as right wingers. Is this a bad thing > ? It's actually quite an honor to be placed in this categegory considering the other choice. The 6 months I spent in Iraq in 2003 was quite a challenge. Not so much from the Iraqi people who enjoyed the security we offered them but from the likes of MSNBC and CNN whose left wing agenda and pro Palestinian anti Israeli stance fired up Al Quaida and created more problems for us liberating Iraq from the Bathe party dictatorship. In time Iraq will flourish as an allie of the United States and perhaps one day we will have Sheraton's and vacation packages to Bahgdad just like we have to Tokyo, Nagasaki and Hiroshima. Mr. Bush we in the Armed Forces thank you for your leadership and so do the people of Iraq. Mr Rove stand tall and smile. Do not fear the left wing propoganda machine and its socialist agenda. The President can hire and fire any attorney he wants. Mr. Rove you go and set that left wing judicial kangaroo organisation straight and fire some buck shot over their left wing cowardly bows. (:

  260. I recall Nancy Pelosi promising us the "Most ethical Congress ever". What I see if William Jefferson, Laura Richardson and Ms. Pelosi herself sponsoring breaks for industries in which she owns stock. There are many other examples but Ms. Pelosi's group doesn't pass the smell test. I was hopeful in 2006 that she meant what she said but it was not true.

    At present, I favor voting every single incumbent, regardless of party out of office. I also favor voting against anyone who supports Pelosi's program.

    I have read both of Senator Obama's books and find racism underlain with Marxism in both of them. I truly fear what will happen should this man be elected. His own words have spoken for him as have Hillary's.

    A lifelong democrat, I find it difficult to support McCain and wish I had an alternative in the form of a John F. kennedy. No such person is on the scene. For the first time in forty years, I may not vote out of disgust. My choice is between a Marxist and an appeaser of a different party. I can't stomach either one.

Al Quada is almost defeated in Iraq and pretty soon we can bring the combat troops home to a well deserved parade. Tough decisions require strong leaders. Placing the United States into a category of third world nation or soon to be is quite humorous especially after spending 6 years in third world countries while serving in the Navy. Just like the time I saw a Rove protester waving a banner that said no blood for oil in Afghanistan. I quietly mentioned to the young lady there is no oil in Afghanistan and we get 73% of our oil from Mexico and Canada. (: Venuzuala sends us a few million barrels and so does Nigeria. Iraq is in last place at 1.3%.

  294. Many of us believe that a number of laws have been broken by this administration. Many in Congress believe this too. The only way to know for sure is to investigate. While the Democrats in Congress have been cautious (too cautious, in my opinion) about launching these investigations in order to avoid the appearance of playing politics AND because they don't want to become distracted by having to hold tons of hearings, the reality is that we are - and must be - a nation of laws. As for this "do-nothing" Congress, without 60 votes in the Senate (where the Republicans threaten to filibuster just about anything) and without a president willing to sign even bi-partisan bills into laws, they are "doing" about as much as can be done.

    I disagree. It won't be easy but you'd be amazed what an American President, not beholden to the OIL CO's and the Lobbyists can do. I mean JFK wasn't a rocket scientist, but he had the leadership and intelligence to guide this nation towards that incredible achievement in under a decade.

    Remember when leaders could get the best out of people and bring them together in a common purpose.     I'm a civilian now. My healthcare is not through or supplemented thru the government. It comes right out of the family paycheck every week just like taxes. As far as the war goes, I thought libs were all about human rights and freedoms. I would think this would apply to people living under a dictatorship that were tortured and killed at random just for Saddams personal amusement. 100,000's found in mass graves under a man that let his own people die so he could use the "food for oil" program (The UN is so wonderful!!) to buy off UN officals to lift the sanctions on his country so he could restart his WMD program. Something he would have succeeded in doing if we never went into Iraq. Then we would not only be dealing with Iran and their Nukes, we could watch Saddam be involved in a Nukes races with Iran!! Now that would be fun!! Which nutcase would pull the trigger first and where!! I'm glad Saddam is dead and proud are military has given Iraq at least a chance at some form of a democracy.

  329. What is the purpose of these hearings. Congress can not enforce its own laws and the laws it passes are subject to judictial review. The only only reason to hold a hearing is to help draft new laws. What law can they draft that would control how the exective branch runs its day to day business that would not be overturned by the court. Congress needs to mind the business that is given to them and stay out of the business of other branches.

That odious little gnome should be doing 10 to 20 in a Federal prison. We also have Stansfield Turner and Jimmy Carter to thank for the total evisceration of the CIA that later left so blind for intelligence in key strategic areas of the world like the Middle East. And this after Lyndon Johnson and Robert McNamara injected this country into a meaningless war that killed 58,000+ of our best.   384. The courts have ruled that a person who notifies the legislative that they intend to evoke 5th admendment protection can not be forced to testify. The protection covers a person in the courts as well as the legislature and administrative branches. The only recourse is to charge the person with contempt and if my memory hasn't gone bonkers only members of a government body can be charged by the legislative body if they refuse to testify. Falsely testifying is a different matter.

    It will be interesting to see if the courts will hold up a legislative right to interfere in an administration's activity. It has oversight but nowhere is there a right to interfere, yet. The administration will argue presidental priviledge is too avoid such interference. What many legal scholars fear is that the courts may slap the house's hand resulting in the adminisration's favor and undo compromises previously worked out by the feuding bodies.

    Simply remember the brohaha over the FBI taking papers from a legislative's office using a search warrant. That compromise will follow the stuff down the drain.

The old "they did it to us now its our turn". I will have to agree that many can carry on affairs while being married if that qualifies.

  390. Waste of time is not an accurate statement. There are 535 members of congress (435 in the house), not including delegates which can't vote on the floor (but can in committee). Congress deals with a lot of things all at the same time. There are so many committees that congress can investigate abuses in the executive and global warming at the same time. Ed Markey (D-Ma, 7th district) released a program called ICAP in which he wants to reduce 85% of carbon emissions by 1950. Congress is working, and just because they're taking up a side issue, doesn't mean they're not tackling the real ones. With so many staffers working in Washington, every issue is always being tackled. Also, with the Republicans making it so difficult to get cloture (filibustering) Democrats and Republicans are forced to work together in a unity gov't. The congress wants to figure out what happened that got us into Iraq, and Rove is not complying. Contempt of Congress is a crime and should be punished.

    Fact: Bush fired a number of US Attorneys for suspicious reasons (seemingly because they refused to prosecute Democrats with weak cases & little to no evidence). Fact: The Republican Congress investigated & impeached President Clinton as a way to bring him down, on what turned out to be an extra-marital affair, at the cost of many millions of dollars. He was impeached for a blow-job. Oh, the horrors!

    There is very strong evidence that the current Administration outright lied to launch an unprovoked attack against another country, ON THE OTHER SIDE OF THE PLANET which has cost nearly half a TRILLION dollars and will cost us far far more in the coming years. Almost as many US Service People have committed suicide since returning as have been killed in Iraq (and Afghanistan) and the so-called (but not) "liberal" media has no raised a peep about this. Bush has always been a failure, he still is, and he most probably always will be. It is only his daddy's connections that ever bailed him out, but even that has run dry by now.

  398. For all the constitutional scholars above who critcize the power andright of Congress to investigate the performance of the Executive Branch, I suggest they read SCOTUS's decision in
    McGrain v. Daugherty, 273 U.S. 135, 47 S.Ct. 319, 71 L.Ed. 580 (1927), which recognized the implicit power of either House of Congress to hold a witness in a congressional investigation in Contempt for a refusal to honor its summons or to respond to its questions.

    During the mid-1920s, there were numerous allegations that the U.S. Justice Department was being mismanaged by its administrator, harry daugherty, the attorney general of the United States. In response to the charges, the Senate passed a resolution that empowered an investigatory committee to hear evidence as to whether Daugherty failed to prosecute various violations of the antitrust laws. Mally S. Daugherty, who was a bank president as well as the brother of the attorney general, refused to respond to a subpoena that was issued by the committee on two occasions, ordering him to appear and to bring designated bank ledgers. The president pro tempore of the Senate issued a warrant to his sergeant at arms that Mally Daugherty be taken into custody. A deputy of the sergeant at arms took Daugherty into custody in Cincinnati, Ohio. Daugherty brought a Habeas Corpus action for his release in federal district court in Ohio. The court declared that the attachment and detention of the witness was void on the ground that the Senate exceeded its powers in directing the investigation and in ordering the seizure of Daugherty. The deputy made a direct appeal to the Supreme Court, which accepted the case for review.

    The Court defined two issues: whether the Senate or House of Representatives has authority to use its own process to compel a private person to appear as a witness and to testify before it or one of its committees in order that Congress can perform a legislative function that it has under the Constitution; and whether the process that was used in this case was directed toward that purpose. Before addressing those questions, however, the Court reviewed some of Daugherty's assertions. Daugherty argued that there was no statutory provision for a deputy and that even if there were, the deputy had no power to execute the warrant, since it was addressed to the sergeant at arms. The Court disagreed. It explained that deputies were authorized to act for the sergeant at arms by virtue of a standing order adopted by the Senate and that Congress recognized their status by establishing and making appropriations for their compensation.

    Daugherty also used the Fourth Amendment provision that "no warrants shall issue, but upon Probable Cause, supported by oath or affirmation," to assert that the warrant was void because its basis was an unsworn committee report. The Court rejected this argument on the ground that the committee members were acting pursuant to their oath as Senators when they issued the warrant. When committee members act on matters within their knowledge, probable cause exists for the action of the committee. The warrant withstood constitutional muster.

    Daugherty also claimed that the warrant was deficient because it stated that he be "brought before the bar of the Senate then and there" to testify. It was not a subpoena to appear before the Senate, nor did he refuse to do so. The Court dismissed this assertion, because it considered the warrant an auxiliary process used by the committee that was acting for the Senate to compel the witness to provide testimony sought by the subpoena.

    The Court finally addressed the central issues of the case: the constitutional authority of the Senate to act in such a manner; and whether the warrant in this case was appropriate. It reasoned that while the power to investigate was not explicitly given to Congress by the Constitution, it was traditionally recognized as implicit in the legislative function since it is a means to obtain necessary information. The Court also referred to various federal laws that demonstrated that either house of Congress has the power to commence investigations and gather evidence concerning activities within its jurisdiction; that committees may conduct such investigations; that in order to fully implement the power to investigate, either house may punish uncooperative witnesses; and witnesses may be given Immunity from criminal prosecutions that derive from their testimonies before the committees. Based upon tradition and statutes, the Court concluded that each house of Congress has auxiliary powers that are essential in order to effectuate its express powers, but neither house has unlimited "general" power to investigate private matters and force testimony. The Senate acted within its powers when it authorized a committee to investigate Daugherty. When the committee sought Daugherty's testimony, it was as a means to perform a legislative function since the purpose of the inquiry was to determine whether the attorney general and the Department of Justice—subjects of congressional regulations and appropriations—were properly performing their duties. The Court deemed that Daugherty's seizure and detention were appropriate because of his wrongful refusal to appear and testify before a lawful congressional committee. It reversed the order of the district court that released Daugherty from custody.

(McDougal's Madison Guarantee S&L alleged $22 million in real estate losses a tiny drop in the bucket of the massive Bush-Reagan trillion dollar S&L debacle. Out of all the S&L execs convicted of fraud during that era, it is a safe bet that the hapless McDougal was the only one sent to a max security prison.)

Americans need to spruce up on their knowledge of how the government is supposed to work. In addition, newer Republican Senators and Congressmen need to read the Constitution. It is obvious that many have not.

At the very least the sale of publc trust. This is not very criminal. No one will really go to prison for creating a mechanism to subvert the process of politics or government. However, it is grounds for the government to end all contact agreements between itself and the guilty parties. his the sort of thing that might have a lasting effect. There have been 3 special congressional elections in the past two months and all three were one by Democrats in districts that have a majority of registered republicans. The district with the lowest number of registered republicans had 72% registered republicans. The RNC arrainged a special meeting last week calling this coming November the Doomsday scenario. Their answer to this problem? Do not associate yourselves, when running for office with President Bush and rarely if ever use the word republican when speaking in public. Too little to late!
    When you defend scumbags like Karl Rove you deserve to lose and lose big! I am glad the Congress is exercising their right as the judicial branch and a co-equal branch of our government.   431. I'm very tired of this "illegal war" stupidity. Do they still teach government in the schools these days? Illegal means not legal or contrary to law. How makes the laws in this country? Congress thats who. Who voted to allow the President to use force in Iraq? Congress thats who. So how is this illegal? How does this violate the terms of Iraq's surrender from the Kuwaiti invasion or the dozen or so UN resolutions that authorized member nations to use force to enforce said resolutions?

    There are many reasons that contribute to high gas prices. One of those is that the Democrats continue to block any legislation that will allow exploration in areas of the US that have huge known reserves of oil.

    Housing crisis was caused in part by the democrats who forced lending institutions to lower their standards thereby loaning money to people to buy houses who could not afford a house.

    Whether you hate Bush or not, get your facts straight and stop being a MoveOn kool-aid drinker.

    1. First amendment - Separation of Church and State - these is no such rule. The portion quoted is meant to keep the government out of the churches business not to keep God out of the government. Recognizing God is not an endorsement of God. I recognize Hillary Clinton, but I sure do not endorse her.

    2. 2nd amendment - they would love nothing more than taking guns away from people. I'm not suggesting a free for all guns for any nut, but lets be sensible.

  436. Conservation and clean alternative energy sources are the key to oil independence, not drilling in sensitive areas such as ANWR. These options are not beyond American ingenuity, or do you think so little of our capabilities?
    And according to the Constitution, each co-equal branch of government is supposed to have "checks" on the power of the others. There is supposed to be a balance. Under the Bush administration the balance has been skewed, and the executive branch has claimed for itself unparalleled power. Every red blooded American should be enraged by this, it is unprecedented in our history.
    Oops, I forgot, there is a precedent. The precedent was when we were under the regime of another King George. And the solution was the American Revolution.
